It is Frederique Constant's policy to comply with the privacy legislation within each jurisdiction in which we operate. Sometimes the privacy legislation and / or an individual's right to privacy are different from one jurisdiction to another. This Privacy Policy covers only those activities that are subject to the provisions of Canada's federal and provincial privacy laws, as applicable.

We may update this Privacy Policy from time to time and make changes to information previously collected, as permitted by law. Information You Voluntarily Provide to Us We may collect personal information from users who: purchase product from us; register a purchased product with us; review our products; participate in on-line surveys; wish to make certain on-line information requests from us; and/or from users who wish to participate in on-line contests, sweepstakes, promotions and discussions sponsored by us on this Site and mobile applications. The type of information so requested or collected by us may include user contact information (like their name, mailing address, and email address), billing information (like credit card number and expiration date) and user demographic information (like their postal code, age or income level). The visitor’s contact information will be used to contact the visitor when the visitor has expressed interest in being contacted (visitors may opt-out of receiving future mailings by emailing a request to us at privacy@citizenwatchgroup.com).

Information Collected Automatically As you navigate through and interact with our Site or services, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions and patterns, including:

Information You Provide to Our Affiliates and Subsidiaries We may get your personal information from a company controlled by or under common control with Frederique Constant.

From time to time, we may utilize the services of third parties in our business and may also receive personal information collected by those third parties in the course of the performance of their services for us or otherwise. Where this is the case, we will take reasonable steps to ensure that such third parties have represented to us that they have the right to disclose your personal information to us.

We receive information about you from these other sources to help us correct or supplement our records, improve the quality or personalization of our service to you, and prevent or detect fraud. Information Collected in Store We may use cameras in stores to keep employees and customers safe and to look for ways to improve our customer experience. This is not meant to suggest that all activities in our Stores will in fact be monitored or subject to surveillance. It is meant to bring to your attention that such monitoring may occur and may result in the collection of personal information from you. We do not use these cameras to identify people except when necessary for security reasons.

Where permitted or required by applicable law or regulatory requirements, we may collect information about you without your knowledge or consent.

4. HOW WE USE YOUR INFORMATION

We will only use your personal information as described in this Privacy Policy or as disclosed to you prior to such processing taking place.

To Provide You Our Services

We will use your personal information to provide information or perform Services that you request. If the applicable information is to be provided or Service is to be performed by a third party, then we will disclose the applicable information to the third party providing the information or performing applicable Services. Your information may be available or provided to third-party service providers and contractors that are contractually obligated to protect your information as disclosed in this Policy.

To Engage in Marketing Activities

Marketing lets us grow our community and update you about new products and services. Where you ask to receive marketing materials from us, we will process your contact information or information about your interactions on our Services to: send you marketing communications and keep you updated about our products and services; provide you with information about events; and deliver targeted marketing to you.

To Provide You with Service-Related Communications  We will send you administrative or account-related information to keep you updated about your account and the Services. Such communications may include information about Policy updates, confirmations of your account actions or transactions, security updates or tips or other relevant transaction-related information. We process your contact information to send you such communications. Service-related communications are not promotional in nature. You are not able to unsubscribe from such communications, otherwise you may miss important developments relating to your account or the Services.

To Provide Customer Support or Respond to You

We collect any information that you provide to us when you contact us, such as with questions, concerns, feedback, disputes or issues. Without your personal information, we cannot respond to you or ensure your continued use and enjoyment of the Services.

For Internal Use

We will use your personal information for the purposes of how our users use our Site including without limitation search terms entered, pages visited and documents viewed. This information may be stored with an IP address. This information is used solely for purposes of enabling us to provide you with a personalized Site experience.

To Ensure the Security of the Services

We care about keeping you secure and safe while using our Services. Keeping you safe requires us to process your personal information, such as your device information, activity information and other relevant information. We may employ companies and individuals to facilitate our Services (“Service Providers”), provide the Services on our behalf, perform Service-related services or assist us in analyzing how our Services are used. The Service Providers are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.

Within Our Corporate Organization

Frederique Constant is a part of a corporate organization that has many legal entities, business processes, management structures and technical systems. Frederique Constant may share your personal information with this organization to provide you with the Services and take actions based on your request.

Corporate Transactions

Personal information may be disclosed or transferred to another party during the course of, or completion of, a change in ownership of, or the grant of a security interest in, all or a part of Frederique Constant or its affiliates through, for example, an asset or share sale, or some other form of business combination, merger or joint venture, provided that such party is bound by appropriate agreements or obligations, and required to use or disclose your personal information in a manner consistent with the use and disclosure provisions of this Privacy Policy, unless you consent otherwise.

Portions of our Site or services may be offered as part of co-branded services and features. The co-branded partners will be identified on the co-branded feature or service, along with an applicable co-branded partner's privacy policy. Consent

We may disclose your personal information for any purpose with your consent. You may change or withdraw your consent at any time, subject to legal or contractual obligations and reasonable notice, by contacting our Privacy Officer using the contact information set out below. All communications with respect to such withdrawal or variation of consent should be in writing and addressed to our Privacy Officer.

Disclosure for Law Enforcement

We may disclose personal information to governmental authorities when legally required to do so, and may cooperate with such authorities investigating claims of illegal activities including, but not limited to, illegal transfer of copyrighted material, fraud, and/or postings or email messages containing threats of violence. Frederique Constant may disclose your personal information in the good faith belief that such action is necessary to: comply with a legal obligation, protect and defend the rights or property of Frederique Constant, prevent or investigate possible wrongdoing in connection with the Service. protect the personal safety of users of the Service or the public or protect against legal liability.

Please note that we may disclose, without restriction, aggregated or anonymized information about our users, which is information that does not identify any specific individual.

6. COMMUNICATION PREFERENCES

To provide our Services to you, we may send you communications related to your transactions, security, or the administration of our Services. From time to time, we may also send you other messages or updates about Frederique Constant, our website, and promotions or other activities. 

If you do not wish to receive non-transaction/security related communications from us, you may opt-out by clicking the “unsubscribe” link in the communication or contact us where specified in the “Contact Us” section, below.

If you opt out of receiving communications from us, we may still send you service communications such as emails about your account, your purchases, or services we are providing to you. Please note that "unsubscribe" requests may not take effect immediately and may take a reasonable amount of time to receive, process and apply, during which time your Information shall remain subject to the prior privacy settings. Additionally, you should be aware that any information provided to third parties prior to your election to opt-out or unsubscribe will not be retrieved or rescinded, unless required by applicable law.

Similarly, you may opt in to receive text messages, telephone calls and mailings. Where our mobile applications allow for the delivery of “push notifications” you can also opt out of receiving these notifications by toggling the “Notifications” switches within our mobile applications to “off.” By downloading and using our mobile applications, you may receive promotional messages, offers, news and information about Frederique Constant within the mobile application itself. These “in app” messages are part of our mobile application’s functionality and cannot be turned off. If you do not want to receive “in app” messages, offers, news and information, do not download or use our mobile application.

7. ACCESS AND CORRECTION OF YOUR PERSONAL INFORMATION

You have the right to ask to access your personal information that you shared with us on our Site or by using our Services. If you want to review, verify or correct your personal information, please contact our Privacy Officer. Please note that any such communication must be in writing.  

When requesting access to your personal information, please note that we may request specific information from you to enable us to confirm your identity and right to access, as well as to search for and provide you with the personal information that we hold about you. We may charge you a fee to access your personal information; however, we will advise you of any fee in advance. If you require assistance in preparing your request, please contact the office of our Privacy Officer. 

Your right to access the personal information that we hold about you is not absolute. There are instances where applicable law or regulatory requirements allow or require us to refuse to provide some or all of the personal information that we hold about you. In addition, the personal information may have been destroyed, erased or made anonymous in accordance with our record retention obligations and practices.

In the event that we cannot provide you with access to your personal information, we will endeavor to inform you of the reasons why, subject to any legal or regulatory restrictions.

We are committed to ensuring that your personal information is kept accurate and up to date. However, it is up to you to update it with any changes. You may notify us via the information in the “Contact Us” section below to request access to, or to correct any personal information that you have provided to us. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

8. RETENTION

We will retain your personal information only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your personal information to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes and enforce our legal agreements and policies. Frederique Constant will also retain Site and services usage data for internal analysis purposes. Usage data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Site, or we are legally obligated to retain this data for longer periods.

We take precautions to protect personal information under our control from misuse, loss or alteration. Our security measures include industry-standard physical, technical and administrative measures to prevent unauthorized access to or disclosure of your information, to maintain data accuracy, to ensure the appropriate use of information, and otherwise safeguard your personal information. Please recognize that protecting your personal information is also your responsibility. We ask you to be responsible for safeguarding your password and other information you share with us through our Services.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Site. This Privacy Policy applies solely to information collected by Frederique Constant.

11. CHILDREN’S PRIVACY

Our Services are not intended to attract children under 18. Accordingly, we do not knowingly solicit or collect personal information from anyone we know to be under 18 years of age. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact us at privacy@citizenwatchgroup.com. If we become aware that we have collected personal information from children without verification of parental consent, we take steps to remove that information from our servers.

Any interpretation associated with this Privacy Policy will be made by our Privacy Officer. This Privacy Policy includes examples but is not intended to be restricted in its application to such examples, therefore where the word 'including' is used, it shall mean 'including without limitation'. This Privacy Policy does not create or confer upon any individual any rights, or impose upon Frederique Constant any obligations outside of, or in addition to, any rights or obligations imposed by Canada's federal and provincial privacy laws, as applicable. Should there be, in a specific case, any inconsistency between this Privacy Policy and Canada's federal and provincial privacy laws, as applicable, this Privacy Policy shall be interpreted, in respect of that case, to give effect to, and comply with, such privacy laws.
